The event is focused on the status of insolvency in the US and UK. Covid has greatly impacted certain industries and insolvency has been a topic of focus since the beginning of the pandemic. However, actual insolvency issues have developed quite differently than expected in many markets. This panel will be a combined group of US and UK insolvency practitioners sharing experiences and expectations for the near future.
David Bart has over 30 years of experience assisting individuals, businesses and their counsel in complex matters ranging from investigations and general consulting to commercial litigation. Assignments include business and strategic analysis, forensic investigation, operational assessments, restructuring, bankruptcy, workouts, and commercial litigation. His clients include public, private, and nonprofit/not-for-profit entities. He has provided financial and litigation consulting services and testimony involving business viability/feasibility, valuation, commercial damages, solvency analysis, fraudulent transfers, forensic accounting, and financial investigations. His engagements include matters in the U.S. Bankruptcy Court, U.S. District Court and State Court as well as arbitration and mediation proceedings.
David’s areas of expertise include strategic planning, feasibility analysis, financial and economic analysis, investigative accounting, statistical analysis, and business valuation involving both profit and non-profit entities.
Andy Stirk, UK head of Womble Bond Dickinson's Banking and Restructuring Team
Andy principally advises clients on non-contentious aspects of restructuring issues, including: Lenders and Private Equity Houses on their positions in relation to distressed businesses; Corporate boards on their restructuring options and directors/fiduciary duties; and other creditors on their rights and options in relation to a distressed debtor.
Andy has a wide range of sector experience including Healthcare, Education, Retail, Leisure & Hospitality, Manufacturing and Domestic Energy Suppliers. Notable experience includes: Advising a lender on its £800m exposure to a multi-jurisdictional group of property companies and the subsequent insolvency processes; Advising a healthcare operator with 36 sites and 1500 residents on its debt restructure and sale to US PE House; Advising the board of a well known UK Retailer on the implementation of a Company Voluntary Arrangement to reduce its lease liabilities; Advising on the first Education Administration for Further Education colleges in the UK under special legislation and the subsequent transfers of the colleges to new providers.
